What is a Complying Development Certificate (CDC) Report?

A complying development certificate is a certificate which

(a) states that particular proposed development is complying development and (if carried out as specified in the certificate) will comply with all development standards applicable to the development and with other requirements prescribed by the regulations concerning the issue of a complying development certificate, and

(b) in the case of development involving the erection of a building, that identifies the classification of the building in accordance with the Building Code of Australia.

A Complying Development Certificate (CDC) report assists Council or the Certifier in addressing compliance of the development against the requirements of State Environmental Planning Policy (Exempt and Complying Development Codes) 2008. The report does not constitute an approval for development and does not override a certifiers opinion or certification.

A Complying Certificate Development (CDC) report includes:

(a) whether or not the proposed development is complying development, and
(b) whether or not the proposed development complies with the relevant development standards, and
(c) if the proposed development is complying development because of the provisions of a local environmental plan, or a local environmental plan in relation to which the council has made a development control plan, that specifies standards and conditions for the complying development, whether or not the proposed development complies with those standards and conditions.

A Complying Certificate Development (CDC) report is not a legislative requirement however is becoming more common practice for Certifiers to include in their document requirements. What do you need to prepare my Complying Development Certificate (CDC) report?

At a minimum, to prepare your Complying Development Certificate (CDC) report I need your:

  • Architectural Plans
  • 10.7 Planning Certificate, Certificate of Title and details of any restrictions noted on the title
  • An other documents relating to your development (e.g. Bushfire, Flood, Biodiversity, Heritage)
